noon. we'll take you through the forecast and help you plan the weeken weekend. >> everything is relatively smooth. except for the live look. another shift in place as they get ready to reopen lanes. it looks like they have started to reopen lanes again for the first hour and a half of our broadcast we were restricted to two lanes over the overpass. >> it's 6:01 now. the family of a toddler hit by a stray bullet says they're not giving up hopes yet. the latest tests show 23-month-old hiram lawrence may be brain dead.

christie smith joins us live from oakland tw the latest. i can't imagine this family is going through. >> i can't either. good morning to you. just two days ago hiram lawrence's parns stood out here asking more more time, anything to give their little baby a chance to survive. now it looks like they're at a cross roads. based on published reports that suggest that an attorney for the family is saying that hiram lawrence may be removed from life support today as two tests have confirm that had the 1-year-old has no brain activity and the family, as heartbreaking as it is, understands what's going on. however, there are conflicting reports alsofohat the family will wait for the results of a third test today before making any final decision. he was in the head on november 28th when someone opened fire at a group of people filming a music video in west oakland. five people were detained on

unrelated charges. this morning on twitter and facebook, there's really an outpouring of support for the family. with people saying things like prove the doctors wrong, hiram. don't give up. do believe in miracles. we have calls to the family attorney this morning. as soon as we hear anything we'll bring that information to you. >> thank you very much, christie. san mateo police looking for a man trying to rob check cashing stores. then on a tuesday a man fitting the same description attempted to rab one on norfolk street. anybody with information about this investigation is asked to contact san mateo police. >> it is 6:03 now. there's $5,000 reward to help catch the person accused of killing birds at a concord park.

15 ducks and geese have died after someone shot them. this is at the corner of willow pass. >> in the mist oflayoffs san jose is adding zel new firefighters. damien trujillo sf live outside fire station 33 which has been closed for more than a year now. good morning, damien. >> reporter: good morning, jon. there's no money to staff it right now. this grant won't get that job done, but it will add valuable resources to the fire department and the city of san jose. 49 firefighters were laid off last year. thanks to a $15 million federal grant the department was able to

rehire those laid off firefighters. but only 22 came back because the others found jobs elsewhere. today the cheief will holding a badging ceremony for nine men and women who transferred from other departments. they'll fill the void left by the layoffs. the transfers have just completed a modified academy put on by the department. and they'll be ready to hop on the rigs and fight fires beginning on sunday. many feel that the department is still understaffed even with today's new hires. no doubt adding more than the 49 faces to the front lines can ease the tension the firefighters have been facing with budget and the stress of fighting fires in san jose. so things are looking up in san ho.

i'm damien trujillo, "today in the bay". >> good news for the department there. thank you, damien. >> the federal appeals court does not look like it will side with supporters on proposition eight in the latest appeal. >> the court heard arguments about whether the judge who struck down prop 8 should have disqualified himself from the case because he's gay. one asked so a married man could never hear a divorce case? they also debated over whether videos of the prop 8 trial should be public. >> according to prosecutors, barry bonds should be serving 15 months in prison. he is accused of misleading a grand jury during his testimony about steroids. a jury convicted bonds of obstruction of justice earlier

this year. >> a suspect in the black friday shooting is facing charge this is morning. the 29-year-old surrendered to police yesterday. he demanded money and tried to steal a gold chain. police arrested another man shortly after the shooting. meantime, a southern california woman will not face felon charges for using pepper spray on black friday. the woman was accused of spraying video game shoppers at a wal-mart near los angeles. prosecutors say the evidence does not rise to the level of a felon. firefighters had to treat ten people for exposure to the pepper spray. it is cold outside. b but it is friday and we're ready for the weekend.

onshore flow already starting to take effect. as we head throughout the weekend, we'll see a stronger on jr. shore push. we have an area of low pressure tracking closer and closer to the california coastline. that means your temperatures will be more mild overnight. 59 degrees inland at noon. up to 60 at 5:00 p.m. in san jose, 59. in stran at 5:00. so we'll take you through the weekend forecast. we'll tell you when the best viewing opportunity will be. first we want to check your drive with mike inouye. >> we have our source, router 10 that would be the chopper. this is 880 past the coliseum. i'm showing a big backup towards

>> welcome back, everybody. it's dark outside. if you look closely, that's the coliseum where a game of football is often played. and basketball is coming back. good news. the time now is 6:12. oakland may be making a push to keep the oakland athletics. mayor quan office put out a notice saying only that she will have an announcement regarding major league baseball today. the team appears to be headed for san jose. but oakland tried to get plans in motion for the very own new stadium. last december the city planning commission approving a proposal for a brand new stadium near jack listen square. at the time it ordereded and environmental impact review and said it would take about a year. the warriors team officials are meeting with sfrap mayor ed lee and giants ceo larry bayer on wednesday to talk about building a new arena near at&t park.

that according to the chronicle. the team also talking to oakland mayor he said the team is a bay area team whether in oakland or san francisco. the goal is to have it open in time for the 2017, 2018 season. the raiders have a beef with a popular burger chain. they are they claim the burger chain violated the raider nation trademark with a billboard that says raid a nations. the billboard is featured prominently outside the coliseum. according on the raiders the ad campaign implies that nations as a partnership with the football franchise. they do not. ranger fan who is love burgers are just confused. >> not a big deal. the nation's burgers. raider nation. i love my raiders. i love burgers. >> the raiders are seeking

time you'll want to view that. and if you can make your way out of the city to the inland cities, you'll get a better shot of that moon. as we head throughout the day, temperatures on the mild side. 60s yet again. the weekend provides more cloud cover with a marine push, onshore flow. deeper marine layer. that means we'll see more mild condition each and every morning. foggy start on saturday, especially at the coast and the north end of the peninsula. through sunday, looking really good. maybe, just maybe a little bit of drizzle. as you make your way home, holding onto upper 50s in san francisco. a little system sneaks on shore on wednesday. it will sit just offshore. might provide a little bit of coastal shower activity. but overall looking dry and cool through thursday. >> still got our eyes on 880 past the coliseum.

look at if slowing from davis street. it's past high where things cleared up. these folks are all jammed up approaching the high street construction. they have yet to completely clear. still have two lanes. and the cones are being picked up as we speak. once that's cleared we should see much improvement. back to the maps. you can use 580 as an alternate. now we're looking at a nice drive for livermore. a 19-minute drive. then look at the dublin interchange. er yerl yux zone might be the reason why there's some slowing, and that's unusual at that portion for friday. we watch that carefully as well. the south bay, no surprises. a typical slow down.

101 at highway 87. the peninsula is also clear. the travel times for 101 and 280 through san mateo, no problems along the peninsula drive as wel well. >> it's an uncommon event about to take place in the sky. if you wake up early enough tomorrow morning you mig be able to see and watch a lunar eclipse in progress. the question buzzing around the newsroom, when and where can we see it? >> well, it's going to be in the western sky, if you're on mountain top in the bay area, or on the beach, that's going to be your best shot of seeing it. we'll be starting with in roughly 24 hours for now. if you're not familiar with what

a lunar eclipse is, it's when the earth casts its shadow on the moon. and what we're seeing tomorrow will be that shadow on the moon caused by the earth and the sun's alignment. the astronomer will be out here tomorrow at the space and science center if you want to come by and take a look. >> yeah, for us the eclipse happens just a little bit before morning twilight. eab as it progresses to totality, we'll sigh the beginning of twi legitimate occur. so there will be color contrast between the changing, transitioning from black sky to blue sky. with the sort of reddish moon there as well. also, as the moon gets lower in the sky, we say see dimming effects caused by the ats fire. you may also notice an illusion. a lot of people notice the moon appears bigger closer to the horizon than when it's up high

in the sky. that's just an illusion. not a real effect. >> we had a lunar eclipse roughly a year ago. you're saying because of the location in the sky, there could be extra colors added in there. it might give off a different look. >> where it's more of a deference in contract. last year's eclipse was high overhead in the middle of the night against a dark, blackish sky. this one will occur against a bluish sky. and so there's a different kind of contrast. also there may be differences in the brightness of the eclipse moon. for those who have really good view of the moon, they might notice there might be some extra maybe a little bit of extra

california may be stuck between a rock and a hard place. if you do not for higher taxes it means deeper cuts to schools, universities and public safety. brown's office posted if taxes don't pass a hole will trigger further cuts. the state faces a projected $13 billion short fall over the next few months. he wants to increase taxes on high income earnings and raise the state sales tax. efforts to bring bart to san

jose are on track and ahead of schedule. they cheered as the board approved a $772 million contract to extend bart to fremont. if the work goes well the board says trains could begin running in december of 2016. more than 18 months ahead of the projected 2018 date. the extension will create 5500 jobs during construction and thousands more incorrectly connected. >> the european union voted to crack down on the way countries borrow and budget. this all sounds a little bit dry. but scott mcgrew says it's critically porn to us. >> it is dry. but europe is our biggest trading partner. a collapse would tear apart our fragile recovery. so the latest. 17 countries who use the your owe as currency have voted to centralize their economies the way the fed controls our money flow. before now the euro was the central currency, but no one group was in charge.

start all week. we have freezing cold conditions in many cities across the bay yet again. we have in the 30s in napa hour by hour forecast shows you we'll be in the 50s by noon. 60 degrees ready to celebrate the weekend. 6:31. first mike has word of a hurry up and wait area in oakland la. >> we're hoping to clear it soon. traffic is just northbound after an earlier traffic break. it looks like all lanes have reopened. yo sue them going back and forth approaching high street after that things should clear up over the next 24 minutes.

a second woman was attacked yesterday morning. both assaults happened in the 24th corridor in the mission district. both women were walking in the early morning hours when they were attacked. they were sexually assaulted and reportedly robbed. >> the former technician accused of skimming cocaine will be back in court. deborah is expected to attend two hearings. the other is to set a trial date. the former krib lab technician is pleading not guilty to the federal charge. she admits to taking small amounts of cocaine in 2009. state prosecutors did not file charges due to lack of evidence. madden's lawyer says the new federal charge does not apply to the case. >> 6:34 now in the midst of lay offs and budget cuts san jose is

adding firefighters to the payroll. they are made possible by a federal grant. damien trujillo downs us lye outside fire station 33 which has been closed for more than a year. good morning. >> good morning. that will not help reopen fire station 33. but it's got to be a slight morale booster in the middle of plummeting moral here. aside from the labor rift. the city of firefighters in san jose laid off 49 firefighters last year. thanks to this grant from fema, the department is slowly replacing the 49 ffrs. 22 of them were resworn in the summer. the others found jobs elsewhere. today there will be a damaging ceremony for nine more. 18 more transfers will go through this modified economy

beginning in february. san jose will soon have staff levels back to where it was two years ago. the grant is good for two years. but the hope is with retirements and attrition, the new firefighters will be able to stay on perm nanly. so good news for the san jose fire department at a time where they really need it. >> and people want the protection as well. >> 6:36. time to check in with christina loren. >> if you're going to be exposed to element this morning, that's the best place for you to cover up. he's got the right idea. it's cold. high pressure kept the skies clear and the winds calm. we're going to see more mild overnight weather throughout the next couple of days with onshore flow developing.

this morning we're already noticing that. you're down to a quarter mile visibility in novato. we have moderate air quality among the peninsula and up at the post in ma rin county. that's an indication of the on jr. show flow starting to purify the air right at the coast. unhealthy levels in the inland valleys. you'll want to limit that all day long. i do like to point out you get the best air quality of the day as we start each day out. at noon your hour by hour forecast sews you the 50s, up to 59 in santa rosa as you break for lunch. and 57 in the south bay. 62 in san jose. that's a forecasted high. the warmest time of the day is typically between 3:00 and 4:00 this time of year. the sun goes down and those temperatures drop like a rock without any wind to mix up the air. one more cold night.

welcome back, everyone. it is 6:41 now. so far this year congress is passing the fewest number of bills in the last ten nonelection years. tracie potts is live in washington with how the public is reacting to all this news. >> this congress hasn't gotten as much done as they have in years past. americans are very frustrated about what's not happening here in washington. now we have new numbers to back that up. the hill tallied the votes of a thousand likely voters in the next election. over two-thirds say this congress needs less pay. they earned $174,000 per member. the leaders get more than that. they also think their tension should be cut. even though -- even if you cut

this morning. >> yeah, you know. we also have an almost full moon out there as we head through tonight into tomorrow morning. a total lunar eclipse that you'll get a good view of in the bay area where the fog could roll in and obstruct your perfect view. i don't think that will be the case for most cities across the bay. i think san francisco might be a little bit tough to see the eclipse tomorrow morning. elsewhere we're looking good. high pressure is finally going to drift to the east. we've been waiting for. less than a quarter mile visibility in novato. your visibilities are going in and out all across the bay area. watch out for patchy fog by the coast this morning. might find patchy fog throughout the inland valleys. by noon temperatures climbing to the 50s. 59 inland as you break for lunch. then enjoy the weekend. 60 inland.

59 in san francisco at 5:00. it's not going to be as bitter cold. it will nudge the big area of high pressure finally out of the way. and a little area of low pressure could bring us about a little bit of rainfall as we head through next week. we'll get to that when i get to your seven day outlook. i want to show you the best time to view the lunar eclipse from your city. you can see a little bit of patchy fog anticipated this morning. and we stop the clock for you at 5:00 a.m. this morning. san francisco will be foggy at that point. livermore, san jose, concord, most of the east bay is getting lunar eclipse.hot of the total we have changes on the way. finally out of the near record low territory overnight. and temperatures are rebounding

nicely every afternoon. the fog will clear. we'll get a lot of sunshine. let's find out your best bet for the drive with mike inouye. >> just liver more showing earlier drive because of the accident at the interchange. we have a fis recovery effort at these spots. oakland shows a much smoother drive for traffic. the volume is bunched up northbound past the coliseum. all lanes have reopened. and traffic is starting to move much better north of 66. the other shot i want to show you is the bay bridge toll plaza. they are starting to bunch up at the bay bridge toll plaza. we do see movement here. off the berkeley curve, no major issues. the south bay looks really good as well.

to give their baby a chance to survive. now it looks like they have a heartbreaking decision in front of them. published reports quote a family attorney saying he'll likely be taken off life support this afternoon after at least two tests show that he has no brain activity. and that a family pediatrician since agreed. and there are also conflicting reports that the family has asked for another round of tests today. police have detained five persons of interest on unrelated charges. a couple of days ago a hospital spokesperson told me they couldn't comment on what was going on because of patient confidentiality. jon and laura, back to you. >> it's just so tragic all around. >> well we could find out as early as today what killed a

promising richmond football player. an autopsy is scheduled for fred thompson. the 19-year-old football player for oregon state university collapsed wednesday night during a pick-up basketball game. the oakland tech high grad was not known to have any kind of heart problems, but early indications are that he may have had a heart attack. bart police arrested a 52-year-old san francisco man that risked his life to rip them off. his name is dennis mcguire. this is what they found at his home. copper wire and volt cutters. they say mcguire recently stole the wire from bart tracks. police arrested him in august for the same crime. bart says the third rail where the copper was taken carries a 1,000 volt charge. so stealing the wear is very dangerous. it's also very costly. copper thefts have cost bart more than $90,000 so far this

and science center where they're high above everything. and don rad will be out here as an astronomer. give us the layman's perspective on what the eclipse is. this is the sun. that's the earth and that's the moon if it wasn't clear. sfwl what people are going to witness tomorrow morning is the moon moving into the shadow of the earth. that only happens when the earth the sun the earth and the moon are in a straight line. >> basically we'll see the shadow cast on a moon. but based on the animation you put together this year is different than last year. how? is there well, the big difference is where the eclipse happens in the sky. last year the eclipse happened high up overhead. this one happens in the early morning hours as the moon is setting.

we could see different colors and different contrast. >> what is the best time to look at this? >> i would say between 5:30, 5:45 and a little bit after 6:00 the moon goes into totality. and then you have the energy to watch it until it disappears over the horizon or when the sun comes up. if you want more information, you can come out here. they'll have telescopes eyeballing the moon. of course, you'll be able to see with your naked eye if you wan to get up early in the morning and look at it. we had an eclipse in the newsroom a couple of days ago. so we're very fortunate.
